Alleged Terrorism and Murder: Court Refuses Bail Application Of 'Bode Itaapa ', Other






A Federal High Court sitting in Abuja on Monday denied the bail application of Olabode Owoeye aka Bode Itaapa and David Samuel.


Hon. Justice Obiora Egwuatu instead adjourned to 29 January, 2025 for trial. 


At the last sitting of the court,  the defendants Counsel, Dr. Igwe ACP (RTD) moved bail application on behalf of the defendants whereas the prosecution counsel also moved that the court should refuse the bail application. 


The court then adjourned the hearing of the application for bail to 4th November 2024 for ruling and commencement of hearing.  


At the resumed hearing in Federal High Court 10 on Monday, Hon. Justice Obiora Egwuatu refused the bail application.


The court held that the seriousness of the alleged offence and the severity of its punishment, compelled the refusal of the bail application.


Justice Obiora Egwuatu held: “Based on the seriousness of the offence, the severity of the punishment, the court is constrained to refuse the bail application.

Background


Announcing Owoeye’s arrest during a suspect parade in Osogbo in July the Osun Police Command spokesperson, Yemisi Opalola, revealed that his arrest in Ilesa came about as a result of credible intelligence at the disposal of the command.


Nigeria Police command also disclosed that Owoeye confessed during interrogation to being a notorious political thug whose group was engaged in the services of Sanya Omirin, the Peoples Democratic Party’s House of Representatives member for Ijesa South Federal Constituency.


In a 7-count charges by the Inspector-Generalof Police informed the court in August that Olubode Owoeye a.k.a Bode Itaapa and David Samuel alongside other cohorts now at large between 2021 and 2022 conspired with others to commit felony to wit: Acts of Terrorism by moving well armed with the aim to create fear in minds of the residents  and killed the following persons; (1) Sigo 'm' (Deceased) (2) Eleran 'm' Deceased) (3) Tafa 'm' (Deceased) and Sikiru Omo Alhaja 'm' (Deceased). 


At the hearing, the defendants plea was taken where they pleaded not guilty.
