Re:Amotekun have no prosecutory power--- who's lying between Osun Assembly and the Executive? By Adebayo Adedeji






The controversy surrounding Amotekun's prosecutorial powers in Osun State has raised more questions than answers. On one hand, the Osun State House of Assembly claims that the amended law does not confer on Amotekun prosecutorial powers. 


According to the Chief Press Secretary to the Speaker of the state assembly, "no part of the law grants prosecutory power to Amotekun."


On the other hand, the Osun Amotekun Corps asserts that Governor Ademola Adeleke has signed into law sections empowering Amotekun to prosecute criminals in court.


The statement signed by the Public Relations Officer of the corps, Yusuf Idowu Abass and published on the official website of the corps, www.osunamotekuncorps.ng, says, "The Corps Commander of the Osun Amotekun Corps, Dr. Hon. Omoyele Isaac Adekunle, has expressed his gratitude to Governor Ademola Adeleke for signing into law Prosecution of cases."


The statement reads further, "Omoyele particularly commended the Governor for the passage of the law, which empowers the Osun Amotekun Corps to prosecute criminals in court."


It is clear that there is a disconnect between the Osun State House of Assembly and the executive arm of government regarding the amended law. The controversy surrounding the appointment of a controversial ex-policeman, Isaac Omoyele, as the head of Amotekun Corps, has added fuel to the fire. Omoyele was indicted by the EndSARS Panel for extrajudicial killings and brutality.


To resolve this issue, it is essential that the two arms of government work together to provide clarity on Amotekun's powers. The government should publish the details of the amended law on its official website to assure the public that it is not designed to persecute opposition members as it is being speculated. This transparency is crucial, especially given the controversial background of the Amotekun Corps leader.
